Coming Court Case

The Gates of Bid A Wee will be in the papers again with the coming Nov 28th court case of Smith v Martin. If of course, it actually gets to a trial.

I have said several times that with it being one persons version against another that it would not be possible to end up with a guilty verdict as how do you get past the 'beyond a reasonable doubt' requirement.

Anyone hear anything about a 'witness'? I heard that there was actually one who was NOT on the Police report and that this person has now come forward.

Anyway it will be in the papers and on TV shortly. My best guess is that 'if' it goes to trial that Smith is going to be disappointed and if he does not prevail then there is a pretty decent chance of a civil suit against him, the BAW Corp, all the Officers of the Corporation individually and the PCB PD.

So, all in all, the matter seems to be something that will be with us for some time to come.

Will you be posting information here about this court business where Mr. Smith said that he got beat up by one of our residents? I have been looking for it in the paper but it seems to have just disappeared after the initial press reports.

Mon. the 28th was set for the Smith/Martin case, that I understand isn't going forward Mon. and will be put off. There is a strong probability that it will be dropped as it has already ben reviewed at a higher level at the State Attorney's Office and flagged to be dropped and that isn't all, new charges of perjury and false statements to the PCBPD may be coming, but this time against Smith.

We will know for sure Monday morning, if it dosen't go then the above is correct, if it goes then the rumor was false. Guess we will know Monday morning.

After a brief court appearance today (11/28) the trial is re scheduled for January 23rd.

Bid A Wee Owner Acquitted of 3 Felony Charges

If you are looking in from out of area the problems are with the 'Bid-A-Wee Corporation' across the street at the 599 home Bid-A-Wee subdivision. They installed 6 locking gates to keep everyone but the homeowners in BAW from getting to the beach. The gates were vandalized, repaired and then the BAW President Jimmy Smith claimed to have been assulted by BAW Owner Martin.

This resulted in 3 Felony charges against Martin and a day long court case on 1/27/12 in which Martin was acquitted after the jury was out for only 45 minutes. Next comes the civil suit against Smith, the BAW BOD, the PCB PD and various others. Should be an interesting summer.

The Officer who arrested Martin, John Kelly, who was recently disciplined by the Department after an Internal Affairs Investigation revealed he arrested Martin without Probable Cause and did not conduct a proper, thorough and complete investigation, has resigned from the Police Force. This does not of course excuse him from being named in the coming civil suit. The interestng thing about the investigation, which is public record, is every officer at the scene was interviewed EXCEPT Chief Drew Whitman who was on July 29th Lt. Drew Whitman and John Kelly's Supervisor. He was at the Smith House. After Smith fed him a load of crap it was Whitman who instructed Kelly to add the charge Kelly claimed in his interview Whitman was never at the scene. He was damn well there. "Assault on a Person over 65" As for Smith and the BAWB Board, you think Martin was a pain in your neck before? I have a feeling 'You Aint Seen Nothing yet"
